Purpose and scope of the General Terms and Conditions<\/h2><p>The purpose of these General Terms and Conditions is to set out the rules governing the use of Decker Aut\u00f3 Kft.\u2019s website, the making of enquiries, requesting quotations, and the servicing, repair, bodywork, paintwork and claims settlement services relating to BMW vehicles.<\/p><p>These General Terms and Conditions apply to visitors to the website, those requesting quotations, and any natural or legal persons who enter into a contract with the Service Provider for servicing, diagnostics, repairs, bodywork, paintwork or claims settlement.<\/p><p>The website is primarily intended to provide information, facilitate contact and enable enquiries. Submitting a form via the website does not in itself constitute the automatic conclusion of a contract, an online order or an online booking.<\/p><h2>3. Concepts<\/h2><ul><li>Customer: any natural or legal person who uses the website, requests a quote or makes use of the Service Provider\u2019s services.<\/li><li>Consumer: a natural person, as defined by the applicable legislation, who is acting outside the scope of their profession, self-employment or business activities.<\/li><li>Vehicle: a motor vehicle handed over by the Customer for servicing, inspection, repair, bodywork, paintwork or damage repair.<\/li><li>Work sheet: a document recording the service request, the vehicle details, the fault reported by the customer, the work to be carried out or already carried out, and any related agreements.<\/li><li>Quotation: a preliminary or final specification of fees and the scope of work provided by the Service Provider in relation to a specific vehicle and a specific job.<\/li><\/ul><h2>4. The Service Provider\u2019s main services<\/h2><p>Decker Aut\u00f3 Kft. specialises in the servicing and repair of premium vehicles, with a particular focus on BMWs. Its services may include, in particular, the following areas:<\/p><ul><li>BMW vehicle diagnostics, using BMW-specific diagnostic tools and in accordance with technical documentation;<\/li><li>automotive electrical installation and fault-finding;<\/li><li>mechanical repairs, such as repairs to brakes, suspension, drivetrain and associated systems;<\/li><li>bodywork repairs, including the use of modern aluminium bodywork and adhesive and riveted repair techniques;<\/li><li>paintwork, using premium-quality processes in line with factory standards;<\/li><li>comprehensive claims handling, including damage assessment, liaison with insurers, parts management, repairs and repainting;<\/li><li>Servicing and repairs for fleet customers, subject to prior agreement.<\/li><\/ul><p>The Service Provider may use terms such as \u201eBMW authorised service centre\u201d, \u201eBMW authorised partner\u201d and similar designations on its website and in its communications that refer to the professional nature of the service. No wording may be used which gives the impression that the Service Provider is an official BMW authorised service centre or a BMW importer, unless it holds specific authorisation to do so.<\/p><h2>5. Use of the website<\/h2><p>The content on this website is for information purposes only. The Service Provider endeavours to ensure that the information on the website is up to date and accurate; however, due to the technical condition and history of the vehicles, as well as the specific nature of the fault, each repair request may require individual assessment.<\/p><p>When using the website, the Customer is obliged to provide accurate information and to refrain from any conduct that may compromise the operation or security of the website or infringe the rights of other users.<\/p><p>The information contained on this website does not constitute an individual technical opinion, a diagnostic result or a binding repair recommendation.<\/p><h2>6. Contacting us and requesting a quote<\/h2><p>The Customer may contact the Service Provider by telephone, by email or via the contact form available on the website. The purpose of the contact form is to facilitate faster and more accurate preliminary arrangements.<\/p><p>It may be appropriate to request the following details on the form: name, telephone number, email address, chassis number, registration number, fault description or identified fault code, mileage, uploading of the vehicle registration certificate, a text description of the problem, and acceptance of the privacy policy.<\/p><p>Submitting the form, making an appointment by telephone or sending an enquiry by email does not automatically constitute an order for the service. For a contract to be formed, confirmation from the Service Provider, acceptance of the quotation, the signing of a work order or some other clear agreement is required.<\/p><h2>7. Conclusion of the contract<\/h2><p>The contract between the Service Provider and the Customer is typically concluded upon collection of the vehicle, completion of the work order, acceptance of the quotation, written or electronic confirmation, or by any other clear agreement between the parties.<\/p><p>The subject matter of the contract may include, in particular, diagnostics, inspection, repairs, bodywork, paintwork, claims handling or a combination of these.<\/p><p>Should the Service Provider, in the course of performing the work, identify any further faults or necessary work not included in the original agreement, it shall inform the Client thereof. The Client\u2019s approval is required for the additional work to be carried out, except in cases justified on urgent, remedial or safety grounds.<\/p><h2>8. Lack of online booking, an online shop and online payment options<\/h2><p>Under the current design, the website does not function as an online shop; it does not offer automatic online purchasing, online payment or binding online bookings.<\/p><p>Due to the nature of the Service Provider\u2019s activities, the duration of repair and diagnostic work cannot, in many cases, be determined in advance on the basis of fixed time intervals. Therefore, appointments and work processes are arranged on a case-by-case basis, either by telephone, email, via an online form or in person.<\/p><p>Should an online shop, online payment or online booking system be introduced on the website in the future, the relevant sections of the General Terms and Conditions must be updated.<\/p><h2>9. The Customer\u2019s obligations<\/h2><p>The Customer is obliged to provide accurate details and information necessary for the use of the service. It is particularly important to provide information regarding the vehicle\u2019s history, previous repairs, known faults, fault codes, damage and conditions of use.<\/p><p>The Customer is obliged to remove from the vehicle any personal belongings, valuables and items not related to the repair. The Service Provider shall only be liable for any valuables left in the vehicle by the Customer if their handover has been specifically recorded in writing.<\/p><p>The Customer is obliged to pay the fee for the service in accordance with the accepted quotation, work order, invoice or separate agreement, and to make the necessary declarations to facilitate cooperation in relation to repairs, the procurement of spare parts or the settlement of claims.<\/p><h2>10. Diagnostics, inspection and fault-finding<\/h2><p>Due to the complex electronic, mechanical and software systems in modern BMW vehicles, the exact cause of faults can often only be determined following diagnostics, a physical inspection and a professional assessment.<\/p><p>Based on the results of the diagnostic test, the Service Provider shall inform the Customer of the faults identified, the recommended repair and \u2013 where possible \u2013 the expected costs. Reading out the fault code alone is not always sufficient to determine the definitive cause of the fault.<\/p><p>Diagnostic and fault-finding work may be subject to a charge even if the Customer does not ultimately commission the repair, provided that this has been agreed in advance by the parties or the charge is clearly set out in the Service Provider\u2019s current price list.<\/p><h2>11. Quotations, prices and fees<\/h2><p>Prices shown on the website or in prior communications may be for information purposes only, unless the Service Provider expressly provides a final quotation relating to a specific vehicle and a specific job.<\/p><p>The final charge may depend on the condition of the vehicle, the nature of the fault, the availability of spare parts, the number of labour hours required, the outcome of the insurance claim, and any further circumstances that come to light during the repair work.<\/p><p>Should the cost of the repair differ significantly from the amount agreed in advance, the Service Provider shall inform the Customer, and shall carry out any further work only after the Customer\u2019s approval, except in cases permitted by law or under a separate agreement.<\/p><h2>12. Components and materials<\/h2><p>Depending on the nature of the repair, the Customer\u2019s requirements, the technical condition of the vehicle and the availability of spare parts, the Service Provider may use original, original-quality, premium-quality or other spare parts that are professionally justified.<\/p><p>The Service Provider may provide the Customer with information regarding the selection of components. The installation of parts supplied by the Customer may only take place on the basis of a separate agreement. In such cases, the Service Provider accepts no liability for the quality, suitability or origin of the parts supplied by the Customer, unless otherwise provided for by law.<\/p><h2>13. Performance, deadlines and handover of vehicles<\/h2><p>The completion deadline depends on the nature of the work, the availability of spare parts, the time required for insurance-related procedures, and any faults identified. The Service Provider endeavours to meet the agreed deadlines; however, for certain repair processes, the deadline may be subject to change for reasons that cannot be foreseen.<\/p><p>The Service Provider shall notify the Customer when the repair has been completed. Upon collection of the vehicle, the Customer is obliged to inspect the vehicle, confirm acceptance of the work carried out, and report any comments without delay.<\/p><p>The Service Provider endeavours to ensure that the vehicle is returned to the Customer only when it is fully ready, safe and in a technically sound condition. If there is a delay due to the need for spare parts or further repairs, the vehicle will be returned in accordance with an agreement between the parties.<\/p><h2>14. Payment and invoicing<\/h2><p>The Customer is obliged to pay the fee for the service in accordance with the invoice, work order, quotation or separate agreement. The Service Provider will provide information on the payment methods in each specific case.<\/p><p>In the case of an insurance claim settlement, the payment and settlement process may differ from the standard procedure and may depend on the insurer\u2019s decision, the assessment of the claim, the excess, depreciation, proof of cover and the terms of the Customer\u2019s policy.<\/p><p>Within the framework of the law, the Service Provider is entitled to enforce its rights relating to performance until payment of the fee has been made. The details of this are determined in each case by the specific agreement and the legislation in force.<\/p><p>Repaired vehicles will only be handed over once the invoice has been settled. Payment can be made in cash or by bank transfer. The Service Provider is entitled to retain the vehicle until the repair charges have been paid in full.<\/p><h2>15. Claims handling<\/h2><p>The Service Provider may undertake the full management of the claims settlement process, which may include damage assessment, liaising with the insurer, ordering spare parts, bodywork repairs, paintwork and related repair processes.<\/p><p>The outcome of the claims settlement process depends on the terms of the insurance policy, the insurer\u2019s decision, the legal basis for the claim, whether cover is in force, and whether the necessary documents are available.<\/p><p>The Customer is obliged to provide the Service Provider or the insurer with the documents, statements and information required for the settlement of the claim.<\/p><h2>16. Warranty of fit for purpose, guarantee and quality complaints<\/h2><p>The Service Provider shall be liable for the work it carries out and the parts it fits in accordance with the applicable legislation and the agreement between the parties. These General Terms and Conditions do not restrict the rights to which consumers are entitled.<\/p><p>In the event of a quality complaint, the Customer is obliged to notify the Service Provider as soon as possible after discovering the fault and to allow the vehicle to be inspected. The Service Provider will investigate the complaint and, in accordance with the relevant legislation, inform the Customer of the possible solutions.<\/p><p>The Service Provider shall not be liable for any fault or damage arising from circumstances concealed by the Customer, previous unprofessional repairs, improper use, external influences, subsequent modifications, use on a race track, inadequate maintenance or faulty parts supplied by the Customer, unless otherwise provided for by law.<\/p><h2>17. Withdrawal, termination and contracts concluded between parties who are not present<\/h2><p>As the website is not designed to operate as an online shop under the current plan, the submission of a form or a request for a quote does not in itself give rise to an online contract for the sale of goods or the provision of services under which a right of withdrawal would automatically arise.<\/p><p>Should a consumer contract be concluded between the parties in the future, either at a distance or outside business premises, the Service Provider is obliged to provide the information and follow the procedures set out in Government Decree No. 45\/2014 (II. 26.). Once the provision of the service commences, the consumer\u2019s rights and any payment obligations shall be governed by the provisions of the Decree.<\/p><p>Parts procured to fulfil a specific order, diagnostic work or repairs that have already commenced, or work processes specific to the vehicle, the legal consequences of withdrawal or termination must always be assessed on the basis of the circumstances of the specific case and the applicable legislation.<\/p><h2>18. Complaints Handling<\/h2><p>The Customer may submit a complaint to the Service Provider verbally, by telephone, in person, by email or in writing. The Service Provider endeavours to investigate complaints promptly, fairly and in a professionally sound manner.<\/p><p>The Service Provider shall investigate verbal complaints as soon as possible and rectify the matter where necessary. If it is not possible to investigate the complaint immediately, or if the Customer does not agree with the response, the Service Provider shall record and handle the complaint in accordance with the law.<\/p><p>In the event of a written complaint, the Service Provider shall act in accordance with the applicable consumer protection regulations and provide a substantive response to the complaint. Should the complaint be rejected, the consumer shall be informed of the remedies available to them.<\/p><p>In the event of a consumer dispute, the consumer may refer the matter to the conciliation body with jurisdiction over their place of residence or stay, or to the competent consumer protection authority. Liability<\/h2><p>The Service Provider shall provide the services in accordance with professional standards, the information available, the condition of the vehicle and the agreement between the parties.<\/p><p>The Service Provider shall not be liable for any indirect damage arising from the use of the website which results from the misinterpretation of general information published on the website, incorrect data provided by the Customer, or technical problems beyond the Service Provider\u2019s control, unless otherwise provided for by law.<\/p><p>These General Terms and Conditions do not exclude or limit the Service Provider\u2019s liability in cases where the exclusion or limitation of liability is prohibited by law, in particular in relation to consumer rights, wilful damage, or a breach of contract causing harm to life, physical integrity or health.<\/p><h2>20. Copyright, trade marks and content<\/h2><p>The text, images, videos, graphics, logos, layout and other content on this website may be protected by copyright or other legal rights. Their use is permitted only with the prior consent of the rights holder, except in cases permitted by law.<\/p><p>The service provider is entitled to record images and audio of cars undergoing repairs and to publish them on its own website, in the media and on social media platforms.<\/p><p>The BMW designation and associated brand marks are the property of the respective trademark owner. On this website, the BMW name is used to indicate the nature of the services, the type of vehicles repaired and the area of specialisation, and is not intended to imply any official connection with the trademark owner that is broader in scope than is actually the case.<\/p><h2>21.
